The U.S. Citizenship and Immigration Services (USCIS) published a notice in the Federal Register on July 16, 2013 asking the Office of Management and Budget (OMB) to approve an information gathering project to obtain data about the usefulness and efficiency of the E-Verify employment eligibility verification program through a Web-based survey of employers across the country. The notice from USCIS – the government agency overseeing lawful immigration to the United States – is available at http://www.gpo.gov/fdsys/pkg/FR-2013-07-16/html/2013-16968.htm.

According to the notice, by gaining an understanding of the E-Verify program – which employers can use to determine whether a newly hired employee is eligible to work legally in the U. S. – the USCIS hopes to identify improvements to better meet the goals of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996. Written comments from the public on the proposed information gathering initiative by the USCIS are encouraged and will be accepted for sixty days until September 16, 2013. The comments and suggestions should address one or more of the following four points:

  • Evaluate whether the proposed collection of information is necessary for the proper performance of the functions of the agency, including whether the information will have practical utility;
  • Evaluate the accuracy of the agencies estimate of the burden of the proposed collection of information, including the validity of the methodology and assumptions used;
  • Enhance the quality, utility, and clarity of the information to be collected; and
  • Minimize the burden of the collection of information on those who are to respond, including through the use of appropriate automated, electronic, mechanical, or other technological collection techniques or other forms of information technology, e.g., permitting electronic submission of responses.

Written comments and suggestions regarding items contained in the notice should be directed to the Department of  Homeland Security (DHS), USCIS, Office of Policy and Strategy, Laura Dawkins, Chief, Regulatory Coordination Division, 20 Massachusetts Avenue NW., Washington, DC 20529-2140. Comments may also be submitted to DHS via email at uscisfrcomment@dhs.gov and must include OMB Control Number 1615-NEW in the subject box. Comments may also be submitted via the Federal eRulemaking Portal at www.Regulations.gov under e-Docket ID number USCIS-2013-0003.
