On April 10, 2018, the U.S. Citizenship and Immigration Services (USCIS) – the government agency overseeing lawful immigration to the United States – launched the E-Verify.gov website to be an authoritative source for information on the E-Verify electronic employment eligibility verification system for employers, employees, and the general public. The E-Verify website is available at www.e-verify.gov.
The user-friendly website provides information about E-Verify and Form I-9, Employment Eligibility Verification, including employee rights and employer responsibilities in the employment verification process. E-Verify.gov allows employers to enroll in E-Verify directly and permits current users to access their accounts. Individuals with myE-Verify accounts can also access their accounts through E-Verify.gov.
E-Verify is a free, easy-to-use internet-based system that employers can access anytime and anywhere directly from a web browser. The system – which has nearly 800,000 enrolled employers – compares information from an employee’s Form I-9 to records available to the Department of Homeland Security (DHS) and the Social Security Administration (SSA) to verify authorization to work in the United States.
Under the Immigration Reform and Control Act of 1986 (IRCA), all employers in the United States are required to verify the identity and employment eligibility of the workers that they hire using the Form I-9. In April 2018, President Donald J. Trump signed the Presidential Executive Order on Buy American and Hire American to help reduce illegal immigration and preserve jobs for U.S. workers.
In February 2018, the White House released the President’s Budget for Fiscal Year 2019 that “invests $23 million to expand the E-Verify Program for mandatory nationwide use, ensuring that businesses employ only those authorized to work in the United States.” The budget also noted over 98 percent of employees are automatically confirmed as authorized to work by E-Verify instantly or within 24 hours.
A 2016 survey by the Society for Human Resource Management (SHRM) found that 83 percent of U.S. employers support a mandatory electronic verification system. The move by the U.S. government toward requiring the “mandatory nationwide use” of the E-Verify system by employers is one of the “ESR Top Ten Background Check Trends” for 2018 selected by Employment Screening Resources (ESR).
