USCIS Informs Employers to Continue Using Form I-9 that Expires on August 31 Until New Edition Released

The U.S. Citizenship and Immigration Services (USCIS) – an agency of the Department of Homeland Security (DHS) – has informed employers in the United States to continue using the “Form I-9, Employment Eligibility Verification” released on July 17, 2017, despite the expiration date listed on the form of August 31, 2019, according to the “What’s New” section of the I-9 Central web page on the USCIS website.

An entry dated August 27, 2019, and titled “Continue to Use the Current Form I-9 for Employment Eligibility Verification” reads as follows: “Until further notice, employers should continue using the Form I-9 currently available on I-9 Central, even after the expiration date of Aug. 31, has passed. We will provide updated information about the new version of the Form I-9 as it becomes available.”

Since the USCIS has not announced exactly when the new edition of the form Fwill be published, employers should continue to use the current version even after the expiration date of August 31, 2019, until a revised version is available. When the USCIS published the current version dated 07/17/17, employers were given two months to switch to the new form. The new form will be available at www.uscis.gov/i-9.

The Immigration Reform and Control Act of 1986 (IRCA) requires employers to complete the Form I-9 for all newly-hired employees to verify their identity and authorization to work in the United States. Form I-9 audits of employers surged in Fiscal Year (FY) 2018 as 5,981 audits were initiated by the U.S. Immigration and Customs Enforcement (ICE) – another agency within the DHS – compared to 1,360 audits in FY 2017.
